abstract: The paper analyses the consequences of the prohibition to transcribe the birth certificate in Italy of a child born through surrogacy. Tracing the most recent jurisprudential pronouncements of the Court of Cassation and the European Court of Human Rights, its objective is to identify a valid means of protection in favour of the best interest of the ‘pending’ child and to assess the reasonableness of adoption in particular cases as a solution to such vulnerable situations.
