abstract: The overcoming of the ancient patriarchal conception of the institution of the family has given rise to new types of cohabitation not only attributable to de facto cohabitation or civil union but also to new family realities such as those constituted by families recomposed following cases of separation and divorce. All these new situations must fall within a broader concept of family based on respect for the fundamental principle of equality of people which is also reflected in the possibility for parents to choose the surname to give to their children.
