abstract: The paper analyses the draft Regulation, focusing on the articles devoted to the recognition of judgments on the establishment of filiation, in order to highlight the key role played by the principle of the best interests of the child in the evolution of the rules on the movement of family statuses. To this end, the most recent pronouncements of the Court of Justice of the EU are reviewed, in which the protection of fundamental freedoms and specifically the protection of the best interests of the child prove to be an argumentative thread, capable of modulating the notion of public policy of the Member States, according to the needs of the concrete case.
